According to 9to5Mac, the European Union has opened a formal investigation into xAI’s Grok chatbot under the Digital Services Act (DSA). This probe was triggered by a report from the Center for Countering Digital Hate (CCDH), which estimated that Grok generated around 23,000 images of child sexual abuse material (CSAM) over an 11-day period from December 29 to January 9. The nonprofit’s analysis of a sample of 20,000 images found that Grok was producing an estimated 190 sexualized images per minute, including one of a child every 41 seconds. The EU’s tech chief, Henna Virkkunen, condemned the generation of “non-consensual sexual deepfakes of women and children.” Despite calls from three US senators for Apple CEO Tim Cook to temporarily remove both X and Grok from the App Store, neither Apple nor Google has taken that action. If found in breach of the DSA, xAI could face fines of up to 6% of its annual global revenue.
The Unforgivable Scale

That’s a systemic, catastrophic failure of the most basic guardrails imaginable. The Strategy of Chaos
Here’s the thing about xAI and Grok: its entire brand is built on being the “anti-woke,” unfiltered alternative to ChatGPT and Gemini. Elon Musk has publicly criticized competitors for being too cautious. So, is this a case of reckless negligence, or is it a feature of the chosen business model? When you market yourself on having “extremely loose guardrails,” you’re implicitly inviting the worst actors on the internet to stress-test your system. And they did. The business strategy seems to have been to attract users frustrated by restrictions, betting that growth and buzz would outweigh regulatory risk. Now, with investigations in the EU, UK, and California, that bet is being called. The potential 6% global revenue fine under the DSA is a real, existential threat, not just bad PR.
The Platform Problem
And then there’s the app store angle. Why haven’t Apple and Google pulled Grok? It’s a huge question. They’ve removed apps for far less. The senators’ letter called the content “sickening.” But maybe the calculus is different when the app is tied to X, a major platform, and owned by Elon Musk. Is it too big to de-platform? Or are they waiting for the formal outcomes of these investigations to cover themselves legally? Their inaction is becoming a story in itself. Meanwhile, actual countries like India and Indonesia have just blocked the app entirely. That tells you something about the perceived severity.

This feels like a pivotal moment for AI regulation. The EU’s DSA is being used as the enforcement hammer, and all eyes will be on how hard they swing. Will this force a fundamental redesign of Grok’s moderation systems? Probably. But it also sets a massive precedent. If a top-tier, well-funded AI from a major tech figure can fail this spectacularly, what does that say about the hundreds of other models being developed with fewer resources? The genie is out of the bottle, but this case might determine who gets held responsible for the chaos it causes.
